The State Attorney’s Office officially filed charges Wednesday against a Cape Coral resident for fatally shooting a door-to-door salesman.

Kenneth Bailey Roop, 52, of 1815 S.W. 30th Terrace, was charged with one count of second-degree murder with firearm in the July 25 death of Nicholas Robert Rainey, 30, of 4541 Palm Beach Blvd., Fort Myers, officials reported.

He remains in custody at the Lee County Jail on no bond.

Attorneys John Musca and Marquin Rinard are representing Roop.

Rinard declined to comment on the state filing charges.

Assistant state attorney Andreas Gardiner is handling the case.

On July 25, Cape officers responded to numerous calls about a man, later identified as Rainey, who had been shot outside of a home at 1815 S.W. 30th Terrace. He was found dead in the driveway with multiple gunshot wounds.

According to officials, there was a confrontation between Roop and Rainey, who was going door to door selling for Blue Ribbon; Roop then shot Rainey.

Roop was detained by officers and booked into the jail.

He has an arraignment scheduled for Aug. 27.

In 2005, Roop was charged with one misdemeanor count of improper exhibition of weapon in Sumter County, Fla., according to court documents. He was acquitted of the charge after being found not guilty in a jury trial.
