A man accused of killing his grandfather then deserting the body in a truck while stopped at a Cape Coral intersection has been found incompetent.

During a court hearing Monday, Clinton Travis Drake, 19, of 146 Pine Lane, Clewiston, was found incompetent to stand trial in the Dec. 6 death of John William Drake, 84. The state had charged him with second-degree murder.

“Two doctors’ reports were presented that both found him to be incompetent,” Samantha Syoen, of the State Attorney’s Office, said.

Lee County Circuit Court Judge John Dommerich signed an incompetency order, which finds Drake officially incompetent to stand trial in the case.

The Department of Children and Families will now transport Drake to a lockdown hospital within the state, where he will remain for treatment.

“If, and when, doctors ever find him to be competent again, then he would stand trial,” Syoen said, adding that the case is stopped until that time.

Assistant State Attorney Marie Doerr was prosecuting the case.

“It’s is what it is,” Syoen said of Monday’s outcome. “He was found to be highly incompetent by two highly-trained doctors, and the judge agreed.”

She added that the finding “was not a surprise to the family.”

His family could not be reached for comment Wednesday.

In about six months, the courts will check in with Drake’s doctors.

Assistant public defender Beatriz Taquechel represented Drake.

She did not return a message seeking comment Wednesday.

On Dec. 6, Cape police received a 911 call about a man slumped over at the wheel of a Dodge pickup at Veterans Parkway and Del Prado Boulevard South. Arriving officers discovered John William Drake inside, bludgeoned to death.

Police began searching the surrounding areas. After a resident reported seeing a man running through a nearby neighborhood, Drake was located in the 1200 block of Southeast 26th Terrace and taken into police custody.

He reportedly told Cape detectives that he had killed his grandfather.
