The State Attorney’s Office declined to file charges against a Cape Coral man accused earlier this year of barricading himself inside of his home.

Billy Jack Monday, 38, of 1461 Venetian Court, was arrested and charged on March 28 with one count of battery touch or strike domestic violence after a woman claimed that Monday was armed with a knife inside of their residence.

The woman, Monday’s wife, told police that she had just fled the home and that Monday was reportedly threatening suicide and acting irrationally.

Four children, ages 3 to 16, were still asleep inside at the time.

Police responded to the home and eventually established contact with the 16-year-old inside via a cell phone. Officers explained the situation, and the teen gathered up two of the children and all three exited the home safely.

Officers were unable to reach Monday, officials reported.

When the police team entered the home, the door to the master bedroom opened and Monday exited the bedroom. He was taken into custody without incident, and the unaccounted for fourth child was found safe in the room.

In April, the state decided not to file charges against Monday because of “insufficient evidence to prove beyond a reasonable doubt,” according to official records. Assistant State Attorney Paul Poland handled the case.

Monday was represented by the Public Defender’s Office.
