A Cape Coral man accused of having sexual relations with a teen pleaded guilty last month to lewd or lascivious battery in a deal with the state.

Aaron Wesley Young, 20, of 4012 N.E. 22nd Ave., was found guilty of one count of lewd or lascivious battery on July 18 in a plea agreement with the State Attorney’s Office.

A second count of interference with custody was nolle prossed – not prosecuted.

Samantha Syoen, spokeswoman for the state, reported that Young was sentenced to one year in jail and given credit for time served for a year.

He also received six years of sex offender probation and was ordered to pay a $350 fine and $500 in court costs.

The victim’s family was in support of the terms of the plea deal.

“The victim did not want to have to go through a trial,” she said. “They are very happy with the resolution.”

Syoen noted that Young has a learning disability.

According to police, Young had sexual intercourse with a girl between the ages of 12 and 16 on several occasions between March 20 and June 17 of last year. The two met on a social networking website before meeting, and they had been dating each other and meeting in private since March 2010.

On June 17, 2010, Young was taken into custody and charged.

Defense attorney Spencer Cordell represented Young.

Cordell did not immediately return a message seeking comment Friday.

Assistant State Attorney Francine Donnorummo handled the case.

In October, the State Attorney’s Office decided not to file charges against Young after he was accused of showing a teen photographs of his penis on a cell phone.

According to court documents, the case was “legally insufficient to prosecute.”

According to police, a 13-year-old girl told an officer that Young showed off the multiple pictures during a bus ride home. At the time, both attended the Alternative Learning Center.

Young was charged with sex offense victim 12 years of age up to 15 years of age.
