A Cape Coral man who has served prison time twice is accused of shooting and wounding a man early Friday morning outside of a home.
Ramon Luis Martinez, 29, of 1321 S.E. Second St., was charged with one count of murder dangerous depraved without premeditation and one count of criminal attempt solicit conspire. He remained at the county jail on Friday.
“Ramon Martinez is no stranger to the Cape Coral Police Department and he is no stranger to gun violence,” police spokesman Lt. Tony Sizemore wrote in a prepared statement.
According to booking records, Martinez has a lengthy criminal history.
Since 2000, he has been booked into the Lee County Jail for various drug offenses, traffic offenses, resisting officers in high-speed vehicle pursuit, aggravated batteries, vehicle thefts and possession of weapon by convict.
Martinez was booked into the jail on a charge of homicide willful kill murder premeditated in March 2002. According to court documents, the charge was dropped due to “insufficient evidence to prove beyond a reasonable doubt.”
He was booked into the county jail on the same charge in May 2004.
No documents immediately available indicted what occurred in that case.
In May 2009, Martinez was sentenced to a year and three months in prison for the sale manufacture or deliver of marijuana, cocaine possession, driving with a suspended revoked or canceled driver’s license and willful flee elude of a law enforcement officer.
He was sentenced to one year and four months in prison in July 2005 for shoot throw a missile into a building or vehicle and possession of a weapon or concealed weapon by convicted felon.
According to officials, the Cape police received a call at 3:18 a.m. about a shooting at 336 N.E. 10th St. The victim told police that he was visiting his girlfriend and was inside of his car when Martinez arrived and shot at him.
The girlfriend reportedly went into the residence to check on her child and seconds later the father of the child, Martinez, arrived in a silver vehicle. He positioned his car in front of the victim’s so the victim was unable to leave.
The victim told police that he put his vehicle in reverse to maneuver around Martinez’s car and as he began to drive away, Martinez exited his vehicle with a gun. Martinez fired one gunshot, shattering the man’s driver’s side window.
The bullet struck the victim in his left bicep before coming to rest in the passenger door. The victim drove off, hearing about three more shots fired in his direction.
Police later found two more bullet holes in the victim’s car.
The victim drove to a gas station and called police. He was treated on scene for his gunshot wound and he identified Martinez as the person who shot him.
Police responded to the home on Northeast 10th Street in an attempt to make contact with Martinez.
A perimeter was established around the home and Martinez exited after a short negotiation. He was taken into custody.
No bond for Martinez was listed Friday. He has a court date set for April 4.
